Please read these Terms and Conditions ("Terms") carefully before using the website or services of First Due Cooling ("FDC," "we," "us," or "our"). By using our website or engaging our services, you agree to be bound by these Terms.
## 1. Services
FDC provides HVAC and refrigeration installation, repair, and maintenance services to residential and commercial customers in Lee and Collier Counties, Florida, and surrounding areas. Specific scope of work, pricing, and timelines for any project will be outlined in a separate estimate, proposal, or service agreement provided to the customer.
## 2. Estimates and Pricing
- Estimates provided are based on information available at the time of inspection and are subject to change if unforeseen conditions arise during the course of work.
- Final pricing will be confirmed in writing (via invoice, proposal, or work order) prior to or upon completion of work, as applicable.
- Emergency or after-hours service may be subject to additional rates.
## 3. Scheduling and Cancellations
- Appointments are scheduled on a first-available basis. We will make reasonable efforts to notify customers of delays.
- Customers may cancel or reschedule appointments by contacting us directly. Repeated late cancellations or no-shows may result in a scheduling fee.
## 4. Payment Terms
- Payment is due upon completion of service unless otherwise agreed in writing (e.g., for larger installation projects with milestone billing).
- Accepted payment methods will be communicated at the time of service.
- Late payments may be subject to interest charges and/or collection action as permitted under Florida law.
## 5. Licensing and Compliance
First Due Cooling performs work in accordance with applicable Florida contractor licensing requirements. Our mechanical contractor license information is available upon request and as required to be publicly displayed.
## 6. Warranties
- Workmanship on installations and repairs is warranted for 1 year from the date of service, unless otherwise specified in a written proposal.
- Manufacturer warranties on equipment and parts are separate and governed by the manufacturer's terms; FDC will assist with warranty claims where applicable but is not the warrantor of equipment defects.
- Warranties do not cover damage resulting from misuse, lack of maintenance, unauthorized repairs by third parties, or acts of nature.
## 7. Limitation of Liability
To the fullest extent permitted by Florida law, FDC's liability for any claim arising from our services shall be limited to the amount paid by the customer for the specific service giving rise to the claim. FDC is not liable for indirect, incidental, or consequential damages, including but not limited to loss of use, loss of income, or property damage not directly caused by our negligence.
## 8. Customer Responsibilities
Customers are responsible for:
- Providing safe and reasonable access to the property and equipment
- Disclosing known issues, prior repairs, or system conditions relevant to the service
- Ensuring permits or HOA approvals are obtained where applicable, unless FDC has agreed in writing to handle permitting
